📡 DREME HOMES - TERMS AND CONDITIONS 📡

Effective Date: April 18, 2026

By accessing, registering for, browsing, posting on, or otherwise using the Dreme Homes website, mobile application, software, and related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions ("Terms").

If you do not agree, you must immediately discontinue use of the Platform.

📄 1. DEFINITIONS

For purposes of these Terms:

• 👤 User means any person or entity accessing or using the Platform.
• 🏠 Lister means any landlord, owner, agent, developer, or person posting a property listing.
• 🔍 Seeker means any user searching for rental, housing, or property opportunities.
• 📹 Content means any text, images, video, data, messages, listings, logos, or material uploaded or transmitted through the Platform.
• 👤 Account means a registered user profile on the Platform.

✓ 2. ELIGIBILITY AND CAPACITY

By using the Platform, you represent and warrant that:

• You have full legal capacity to enter binding agreements.
• All information provided is true, accurate, complete, and current.
• You are authorized to act for any company or property owner you represent.
• Your use of the Platform complies with all applicable laws and regulations.
• We reserve the right to request proof of identity, ownership, agency authority, or business registration at any time.

🔐 3. ACCOUNT REGISTRATION AND SECURITY

You are solely responsible for:

• Maintaining confidentiality of login credentials.
• Restricting unauthorized access to your account.
• All activities occurring under your account.

You shall immediately notify Dreme Homes of any suspected unauthorized use or security breach.

We may suspend, restrict, or terminate any Account at any time without prior notice where security, fraud prevention, or policy enforcement requires it.

🛰 4. PLATFORM ROLE AND DISCLAIMER

Dreme Homes operates solely as an online intermediary platform. Unless expressly stated in writing, Dreme Homes is NOT:

• ❌ A landlord
• ❌ Property owner
• ❌ Real estate broker
• ❌ Agent of any user
• ❌ Party to tenancy or lease agreements
• ❌ Custodian of deposits exchanged outside the Platform

We do not guarantee availability, ownership, legality, habitability, pricing accuracy, or suitability of any listed property.

🏘 5. LISTINGS AND LISTER OBLIGATIONS

Each Lister represents and warrants that they have lawful authority to advertise the listed property.

Listers shall ensure that all listings are:

• ✅ Accurate
• ✅ Non-misleading
• ✅ Current
• ✅ Lawful
• ✅ Free from infringing or deceptive material

Prohibited listings include, without limitation:

• ❌ Fraudulent or non-existent properties
• ❌ Duplicate spam listings
• ❌ False ownership claims
• ❌ Bait pricing
• ❌ Discriminatory offers prohibited by law
• ❌ Illegal occupancy arrangements

Dreme Homes may remove, reject, edit, demote, suspend, or permanently disable any listing at its sole discretion and without liability.

👨‍💻 6. SEEKER RESPONSIBILITY

Seekers acknowledge and agree that they bear sole responsibility for independently verifying:

• 🧑 Identity of the Lister
• 🏡 Property ownership or authority
• 📋 Rental terms
• 🛡 Safety and condition
• 💰 Deposits, fees, and payment requests
• ❓ Suitability for intended use

No reliance shall be placed solely on Platform content.

📝 7. USER CONTENT LICENSE

You retain ownership of Content you lawfully own. By uploading or submitting Content, you grant Dreme Homes a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, display, distribute, promote, and otherwise use such Content for operation, improvement, security, and marketing of the Platform.

You warrant that your Content does not infringe any third-party rights.

💬 8. MESSAGING, MONITORING, AND DATA RETENTION

The Platform may provide messaging or communication tools.

You shall not use such tools for:

• ❌ Harassment
• ❌ Threats
• ❌ Fraud
• ❌ Spam
• ❌ Illegal solicitations
• ❌ Distribution of malware
• ❌ Circumvention of Platform rules

Dreme Homes may monitor, filter, review, preserve, disclose, or remove communications where reasonably necessary for security, abuse prevention, legal compliance, or enforcement.

Messages may be automatically deleted after a retention period determined by us, including approximately three (3) months, unless longer retention is required.

💵 9. FEES, PAYMENTS, AND REFUNDS

Certain features may be paid services.

Unless expressly stated otherwise:

• All fees are payable in advance.
• Fees are non-refundable.
• Taxes, charges, and payment processor fees may apply.
• Failed or reversed payments may result in immediate suspension.
• Dreme Homes may change pricing at any time prospectively.

🔨 10. SUSPENSION, TERMINATION, BANS

Without limiting any other remedy, we may immediately suspend, restrict, terminate, or permanently ban any User or Account where we reasonably suspect:

• ❌ Fraud
• ❌ Scams
• ❌ Misrepresentation
• ❌ Repeated policy breaches
• ❌ Security threats
• ❌ Illegal conduct
• ❌ Evasion of prior bans
• ❌ Harm to users or Platform reputation

We are under no obligation to provide advance notice.

🔎 11. APPEALS

Where an appeal process is offered, submission of an appeal does not guarantee review, response time, reinstatement, or reversal.

Dreme Homes may require documentation and may reject appeals lacking sufficient evidence.

All decisions made after review shall be final to the extent permitted by law.

🚫 12. PROHIBITED USES

You shall not:

• ❌ Scrape, crawl, mirror, or harvest Platform data
• ❌ Use bots without written authorization
• ❌ Reverse engineer Platform systems
• ❌ Introduce malicious code
• ❌ Manipulate search rankings or reviews
• ❌ Impersonate others
• ❌ Circumvent technical restrictions
• ❌ Use the Platform for unlawful purposes

⚠ DREME HOMES CAN TAKE ANY LEGAL ACTIONS AS PERMITTED BY LAW IF ANY PERSON IS FOUND PRACTISING ANY OF THIS;

© 13. INTELLECTUAL PROPERTY

All rights, title, and interest in the Platform, including software, trademarks, branding, databases, layouts, and designs, remain the exclusive property of Dreme Homes or its licensors.

No rights are granted except those expressly stated herein.

⚠ 14. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

🧾 15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREME HOMES SHALL NOT BE LIABLE FOR ANY:

• ❌ INDIRECT DAMAGES
• ❌ INCIDENTAL DAMAGES
• ❌ SPECIAL DAMAGES
• ❌ CONSEQUENTIAL DAMAGES
• ❌ LOSS OF PROFITS
• ❌ LOSS OF DATA
• ❌ LOST OPPORTUNITIES
• ❌ USER DISPUTES
• ❌ PROPERTY MISREPRESENTATIONS
• ❌ PERSONAL DECISIONS MADE USING PLATFORM CONTENT

Where liability cannot be excluded, our aggregate liability shall not exceed the amount paid by you to Dreme Homes in the preceding twelve (12) months for the specific service giving rise to the claim.

👑 16. INDEMNITY

You agree to defend, indemnify, and hold harmless Dreme Homes, its directors, staff, affiliates, and contractors from any claims, liabilities, damages, losses, or costs arising from:

• Your use of the Platform
• Your Content
• Your breach of these Terms
• Your violation of law
• Disputes with other Users

🌡 17. FORCE MAJEURE

Dreme Homes shall not be liable for delays or failures caused by events beyond reasonable control, including outages, cyberattacks, strikes, natural disasters, regulatory actions, or telecommunications failures.

📝 18. MODIFICATIONS

We may amend these Terms at any time by posting updated Terms.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

⚖ 19. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of Kenya.

Subject to applicable law, disputes shall be submitted to the competent courts of Kenya.

✂ 20. SEVERABILITY

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

📀 21. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Dreme Homes concerning use of the Platform and supersede prior understandings relating to the same subject matter.
